Open Letter To Arie Folger : YOU HAVE FAILED MISERABLY

Dear Rabbi Arie Folger,

We were in contact some months ago when I readily admit to knowing very little about the case and readily swallowed what you told me.

Since then, I have learnt a lot more most of which is horrifying. Yes, Adrian is right, the Austrian Court system is thoroughly corrupt. One judge who is highly prejudiced against Beth was allowed to preside over the case each time it came to court and even on appeal when an independent judge should have been appointed. That would never be allowed in England and shows an unprecented level of corruption in the Austrian court system. I long for the day when both Thau and the vile Gottlicher are brought to book for their crimes. Gottlicher is being investigated and about time. They should both be struck off, hopefully imprisoned for abusing their positions and never be allowed to practise again.

The role of IKG and the various rabbis such as yourself, defies belief. What is the point of being so ritualistically religious if you don't act ethically and kindly?

And where are the boys? Why did they not have their bnei mitzvah ceremonies? Why have they been allowed to disappear with their abusive and mentally unstable father? Is no-one concerned for the safety of those boys? I ask you again, where are they?

No more being economical with the truth. No more telling me I don't know the whole story, how without proof and with false statements from 'friends' Beth was deemed mentally unfit to care for the children. A false psychiatric report dubiously obtained is not evidence.

When you stand and are judged by the highest court you and your colleagues will be found doubly wanting.  You were supposed to use your position to be a good Jew and make the world a better place. You have failed miserably.

A story about Chelm - Part II

 

This is a continuation of the Chelm story. You can read the first part here.

Some years later, a gathering was organised for all the elders of all the different towns across the entire land. It was a very important gathering where there was lavish food and dignitaries in attendance. Everyone knew it was an important gathering because the elders told everyone it was.

The inhabitants of all the towns and cities (other than Chelm) had been pleading with their own elders for many years about the poor man in Chelm whose house was on fire, but sadly, the elders had been unable to do anything to help despite being very important. But, knowing that the elders of Chlem would be attending the infamous gathering, the elders from other towns were requested by their townsfolk to confront the elders of Chelm to demand to have the man's fire put out. After all, this would be easily accomplished given their closeness with the king of Chelm.

At the gathering, the participants were reminded how important they were and how important the gathering was. They even sent out messages during the gathering to villagers far and wide to inform them that the gathering was underway and that it was very important. Over the next few days, there were many speeches by many people. Some of the speeches praised Chelm and their elders for having such an elite fire service, but never mentioned the man whose house was on fire. Some speeches thanked all elders for protecting all their respective villagers, but never mentioned the man whose house was on fire. There were fables told how heroic elders went to extraordinary lengths to gallantly rescue people in all manner of situations, but never mentioned the man whose house was on fire.

In-between the speeches, friendships were forged, food and wine was consumed, ancient legends were reminisced and nostalgic tales were retold.

No one will ever know for sure whether the fire in Chelm, and the man's suffering, was mentioned at the important gathering, but the fire in Chelm continues to burn to this very day.

It's the boys' barmitzvah in a few weeks and it will be good if you help to bring Shalom to the situation so that Beth is made welcome at this important occasion in their lives.

You might like to take it up with Vivian Wineman. He is president of the BoD for a few more weeks, and will probably be at meetings where Muzicant will be present. As Viv’s term of office is coming to an end he might be more inclined to press for some progress as he won’t have to sit at meetings with Muzicant after May.

It’s a thought and might be worth a try.

I understand that Ariel Muzikant has recently been appointed interim president of the EJC.

As interim head of this important organization I would expect him to serve the interests of the entire European Jewish community.

I am thinking specifically of the appalling travesty of justice regarding Beth Alexander and her twin sons Benji and Sammy Schlesinger in Vienna.

A campaign spearheaded by UK Chief Rabbi Ephraim Mirvis and Dr Mathew Offord, Beth's Member of Parliament now has thousands of Jews and non Jews from around the world following this case in horror and disbelief that two young boys have been denied the loving care of their mother and all their maternal family for so many years.

To date pleas of help to Ariel Muzikant have fallen on deaf ears.  Many around the world are looking at the role of the IKG in this case with alarm and incredulity.

If he cannot help resolve an ongoing crisis in his own community I am wondering how he could possibly stand as representative of European Jewish Communities.

The removal of Moshe Kantor showed the world that the European Jewish community stands proud with morals and ethics.

In his new position, I and all the thousands of people around the world following this case would expect Ariel Muzikant to step up to the moral and ethical leadership required by this prestigious position and do everything possible to reunite this family.

I have been following for years the tragedy of Beth Alexander, a Mother prevented from seeing her children.

Needless to say, this is one of the crassest possible violations of human rights, let alone Jewish values. It reminds us of the darkest times in our history but is, incredibly, happening today in Vienna under the appearance of legality.

There is no need to elaborate to which extent this is a stain and a major disgrace on European Jewry and Jewry in general and for Austrian Jewry and Austria in particular.

Many eyes of concerned Jews around the world are now on you. I hope that you will seize the chance to demonstrate that the EJC Presidency is not just for the decorum but a position of real Jewish and human leadership.

I am one of several thousand of Beth Alexander’s supporters and I sure you know that there is an increasing awareness worldwide of this appalling situation.


Something very shady has gone on here with a whiff of corruption at the heart of it. Dr Schlesinger is a known perpetrator of domestic violence, who had been previously legally barred from the household, so he could not have been awarded sole custody of his children without players influencing the courts behind the scenes. Schlesinger could not have acted alone, and it is known that some of his contacts in the IKG (Konstanze Thau and Jacob Biderman) influenced court decisions in Schlesinger’s favour in 2011.

I’m sure you’re looking forward to spending seder night with family members which sadly is not the case for Beth. Another year without her precious sons. Can you even begin to imagine what this is like this living nightmare?

She has in fact never heard her own children recite ma nishtana, nor has she spent seder night. She is being deliberately and systematically erased by her ex-husband out of her children’s lives.

The boys are now 12 and their bar mitzvah is coming up.They need their mother in their lives.

As a man with influence you know what needs to be done to resolve this terrible matter for all the family. Please do the right thing.

Dear journalists,

Thirteen years ago a young Jewish woman, Beth Alexander, from the UK met a young Jewish doctor, Michael Schlesinger, from Vienna. After a whirlwind romance, they married and moved to Vienna. She soon realised that her new husband was violently abusive but she became pregnant so she stayed and tried to make things work. When twin boys were born things only got worse. She filed for divorce and the husband decided to punish her by taking her boys away from their mother. Ten years ago the boys were taken from her home by armed police and social workers - none of whom could understand why such aggressive force should be necessary to take two babies from their obviously loving mother.

Schlesinger had convinced the family courts that Beth was mentally unstable (she wasn't) and unable to cope as a mother. A family friend and member of the Jewish community, Judge Konstanze Thau, took it upon herself to call the presiding Judge and urge her to give full custody to Schlesinger. The Jewish community turned their backs on Beth. Even erstwhile friends were instructed by their husbands not to get involved. As time went on Beth was allowed less and less contact with her sons.  Eventually she returned to the UK where she retrained as a family lawyer. Her appeals to the Austrian court have been denied and she is currently barred from all contact with the boys. Over the years she has engaged a number of eminent Austrian lawyers to represent her, and all have mysteriously pulled out for no apparent reason.

Rabbi Jacob Biderman of the Lauder Chabad Campus went out of his way to support Schlesinger by barring Beth from all school events. He testified to the court that the boys were thriving with their father, despite obvious regression in both boys and one of them continuously smashing himself into a concrete wall to try and numb his pain. Biderman forwarded all Beth's pleading emails to Schlesinger and his lawyers and to Judge Konstanze Thau. You have to understand that Biderman is 100% reliant on donations from the community to finance his projects and his lifestyle. Prominent Rabbis from around the world tried to intervene and received assurances from Biderman which were promptly ignored.

So what is the hold that a not rich doctor has over the Vienna Jewish Community (The IKG, headed by Oskar Deutsch)? Schlesinger's sister, Tina, is amicably divorced from the Ukrainian-Austrian Oligarch, Maxim Slutski. Judge Konstanze Thau is a family friend of both the Schlesingers and the Slutskis. Slutski basically funds the Jewish community along with the Austrian Government who pay an unaudited amount of guilt money.

Slutski, a Russian speaker, is now overseeing the absorption and care of 500 Jewish Ukrainian refugees hosted by the IKG. Ironically, he could be donating money to the refugees that he embezzled from their own tax money in Ukraine.

If you want to know more about Beth's story, go to the Facebook group: Reuniting Beth with her Boys. We are 6.3 thousand supporters who only want to see these innocent boys back with their mother. We do not want to expose the corruption in the Austrian Family Court, or in the IKG, or the Jewish community of Vienna. However, we will do whatever it (legally and non-violently) takes to get justice for two little boys caught up in a web of corruption originating with Russian money in Vienna.

Open Letter To Ariel Muzicant : THE IKG CONTINUES TO INFLUENCE EACH BIZARRE COURT DECISION TODAY

Ariel Muzicant has recently been featured in a magazine article to profile his life. Here is the opening paragraph in English and the original German.

Across from his desk in the downtown office, so always in view, hangs a huge photo of his large family. Children, children-in-law and lots of grandchildren. How many is it? "Many, but we don't count," smiles the patriarch. Ariel Muzicant doesn't want to reveal his private life at all and may even ignore his 70s. A new life began for him at 60 and he likes to talk about it.

Dear Mr Muzicant,

I have been learning of how the IKG contributed to the appalling miscarriage of justice that I refer to in the title of my email. I am one of several thousand of Beth Alexander’s supporters, and I should inform you that there is an increasing awareness worldwide of the shady activities of the IKG and the extortionate amount being provided to them by the Austrian government. The international community is appalled by what they have learned about the IKG, and is seeking to put a stop to these inflated benefits until justice is restored to Beth Alexander and her extremely vulnerable children.

It is obvious to anyone with an ounce of intelligence that a known perpetrator of domestic violence, who had been previously legally barred from the household, could not have been awarded sole custody of his children without players influencing the courts behind the scenes. Schlesinger could not have acted alone, and it is known that some of his contacts in the IKG (Konstanze Thau and Jacob Biderman) influenced court decisions in Schlesinger’s favour in 2011. It seems highly probable to the international community that the IKG continues to influence each bizarre court decision today.

Your recent interview in Wina was an interesting read, including the part about your children and countless grandchildren. I’m sure you’re looking forward to spending seder night soon with family members, and hearing a grandchild or two recite ma nishtana. Beth Alexander has never heard her own children recite ma nishtana, nor has she spent seder night, or any other chag or even a birthday with them for over a decade. Can you stop and ponder that for just a moment? She is being deliberately and systematically erased by her ex-husband out of her children’s lives.

The boys are now 12 and their bar mitzvah is coming up.They need their mother in their lives. Please will you exercise integrity and compassion, and exert the influence that you say you “naturally” possess as an “Elder Statesman” to try and reverse the terrible situation that stands today. And I think you know fully well how this can be achieved.

You will recall that we had correspondence with you and your department in 2020.   In order to remind you we are attaching a copy of our initial letter to you dated 20/02/20 setting out our position.  We also attach copies of subsequent exchange of emails ending with our email to you of 27/07/2020.

We are writing to you now to give you an update of what has happened since.   

As you did not provide any useful or practical help to our daughter Beth she was left on her own to try to pursue whatever avenue she could which would lead to having contact with her twin sons Sammy and Benji.

As you know, in 2016 she left Vienna after Judge Gottlicher made a order for supervised access only to her sons, and this was only allowed after Beth had had ‘parenting classes’. This was the final humiliation for Beth and she was compelled to return to England. Following this the only form of contact which she could have was by way of telephone calls or skype calls. Her ex husband Michael Schlesinger allowed only very minimal access in this way and only after Beth had tried many many times to call without him answering. As you can appreciate this was very frustrating for Beth also an abrogation of the children’s rights as human beings to have meaningful contact with their mother.   Beth was being totally controlled and abused by her ex husband.

In an attempt to try and gain better contact Beth applied in December 2020 under the provisions of the Hague Convention for a holiday in England with the twins (later amended to a holiday in Austria) a visit with the children once a month in Austria for a day and weekly telephone calls. The matter was referred again to Judge Gottlicher in the second district court.

After several hearings Judge Gottlicher made an extraordinary order on the xx December 2021. She ordered that it was ‘in the best interests

 of the children that Beth should have NO CONTACT whatever with the children, ‘that is – no visits, no telephone calls, no skype calls!’

From any perspective this decision is inhumane, totally absurd and has no connection with reality.     How can it be in the children’s interests not to have contact with a mother who carried them in her own body for 9 months, who gave birth by caesarian section, who had the connecting umbilical cord to them and nourished them with her own breast milk.    She has only the greatest love for them and they would for her if only they would be allowed to show it.    We are attaching videos of us with Beth and the twins.    The love shouts out to you!   Can’t Judge Gottlicher see this!    There can be no possible justification for this outrageous decision – THE TWINS ALLOWED NO CONTACT WHATSOEVER WITH THEIR MOTHER!!!!!

Do you expect a loving mother to just accept this decision and walk away from her children and never speak to or see her children again?

Well Beth loves her children too much and so do we!   The court decision makes no sense whatsoever!   No reasonable person would expect such a decision.

Beth wants to have input in the lives of her children and she wants JUSTICE!

Beth has therefore taken matters into her own hands and away from the judicial system which from any viewpoint  is either incompetent or corrupt.

On 30th January 2022 Beth launched an International Campaign to be reunited with her sons, Sammy and Benji. The campaign was launched on facebook under the banner ‘Reunite Beth with Her Sons’.  It was endorsed and supported by the Chief Rabbi of Great Britain and the Commonwealth Rabbi Ephraim Mirvis, Beth’s local member of Parliament Matthew Offord, The CEO of Jewish Women’s Aid,  the Jewish Telegraph Manchester, and the Jewish Chronicle. Since 30th January the campaign has attracted thousands of supporters for Beth from all over the world who have condemned Judge Gottlicher’s decision.

As all parties to this case are jewish the case has attracted massive attention throughout the jewish world – UK, USA, Israel, Australia, Argentina, Italy and more and has led to many many letters being sent to the President of the IKG, Oskar Deutch condemning him and his jewish community for allowing such a travesty of justice to take place on his watch.    You can read all these letters on the facebook website.   Many liken the proceedings to the events of the Holocaust, children ripped from their mother’s arms by armed policemen in of all places Austria!!!!   What were you thinking!
We are attaching a few of the letters just to show you the extent of anger this has caused around the jewish world.     It was specifically expressed in each letter independently that the situation had undertones of the holocaust perpetuated by the Austrian Jewish Community (IKG) to Beth who although jewish herself was considered to be an outsider because she is British.

Also attached is a copy letter from the Manchester Jewish Representative Council, a body which represents the Jewish Community of Manchester.

At the same time as running the campaign and as a last resort, and in an attempt to allow your justice system to show that it can be impartial, fair and just, Beth has lodged an application in BG Leopoldstad, the second district court Antrag auf Ubertragung der alleinigen Obsorge, a new application for transfer of sole custody to her.

The application has been issued under reference GZ#3Ps/79/14h. This is an opportunity for your country to show that it has a heart and a mind to do the right thing free from any external influences and to show the world, which is watching, that you are an upright, democratic western democracy, upholding civilised values and worthy of respect.

Dear Dr. Zadic

We are the parents of Beth Alexander and the grandparents of Benjamin and Samuel Schlesinger. We wrote to you in 2020 about the terrible situation of our daughter and her children caused by your justice system. We were very disappointed that we never received any satisfactory response or proposed satisfactory solution from you. Our daughter and grandchildren continue to suffer.

As a result of the latest court decision in December 2021 which denied Beth ALL ACCESS to her children ie NO PHYSICAL CONTACT, NO HOLIDAYS, NO PHONE CALLS, NO SKYPE CALLS, Beth has now launched an international social media campaign to bring the injustice of your system to the notice of a wider global audience. The campaign has attracted many thousands of supporters all condemning either the incompetence and/or the corruption of your justice system.

The anger of people towards your country has been growing even louder since the latest Landesgericht decision a few days ago.  We think there is no better way to express this anger than to link a letter which was emailed to you (and which you may not have seen) from one supporter.

We are also enclosing a copy of a post from another supporter on Beth’s Facebook page, which shows how the English courts dealt with a similar situation in England. This decision is completely opposite to your judicial system’s decision. Comparing the two its quite clear which makes the most sense and which is in the child’s best interests.

Your court’s decision will lead to further parental alienation when what is needed is help in creating a loving caring relationship between children and both their parents. You are allowing manipulation and destruction of two young vulnerable boys with the sole intention of completely removing a loving mother from their lives.

We are further enclosing a copy of a letter which we emailed to you last week (see above) together with copy documents referred to.

We have seen on your own Facebook page how you welcomed the new U.S.  ambassador to Vienna. How you discussed cooperation between your countries and how you would deal with corruption. So it seems that you accept corruption exists in your country. We saw how you celebrated your country’s new initiative to help women who are suffering domestic violence and abuse.

We also remind you of an interview which you gave to Die Kleine Zeitung, “I want to modernize justice and bring it nearer to the people” You said in an interview with The Independent, the English newspaper which was published on 19th February 2020 ‘Being perceived as different makes people vulnerable. It makes them dependent on the impartiality of the rule of law’. Is Beth, because she is English perceived as different to Austrians? Is she therefore vulnerable? She is therefore ‘dependent on the impartiality of the rule of law’. These are your words. Your system has shown no impartiality but the complete opposite – total bias in favour of Beth’s ex husband.

These are very fine words and noble sentiments but unless you put your words into action how can you gain justice for the people, or the respect which your office of state expects.

You have now been in office for two years. What practical changes have you brought to the system? You are obviously not accountable to us but you are accountable to yourself.

Admittedly we are primarily concerned only with our daughter’s case but if this case is representative of your system you have a lot of work to do and the recent court decisions of Judge Gottlicher and the Landesgericht show you have a long way to go.

Let the redress of injustice in our daughter’s case be the first light to be seen that you do in fact care for justice and the common man and your transparent action will be a beacon of hope for the sufferers of domestic abuse and violence in your country.

You are the head of the judicial system. It is your responsibility to supervise and administer the system so that it is fair and unaffected by corruption or incompetence. Please do not tell us that you cannot interfere  in a decision which has been made by the court. Do not tell us that you cannot intervene in a decision of the Supreme Court. If decisions in whichever court are made which are blatantly incorrect or against natural justice or seemingly corrupt you as the ultimate representative of justice must intervene otherwise there is no rule of law in your country. Without the existence of the rule of law you don’t have democracy. Without democracy you have anarchy or dictatorship.

You are the head of the judicial system in Austria. You are a highly qualified lawyer as I am (I am a retired lawyer) as is Beth who is a Cambridge Graduate and a practising family lawyer so we are all familiar with judicial systems. It is blatantly obvious to everyone who has read the court documents that all the decisions have absolutely no legal merit and are an insult to Beth’s intelligence as a Cambridge Graduate and her qualifications as a practising family lawyer.

You now have the opportunity to show you are strong and a leader not to be manipulated for other people’s purposes. You have an opportunity to help the vulnerable, save the oppressed and disadvantaged. Isn’t that the reason why you entered politics in the first place. Don’t fail in your mission, don’t be controlled by the corruption which is blatantly visible in your country.

We are the parents of Beth Alexander and grandparents of Samuel and Benjamin Schlesinger (“the Schlesinger twins”).

We had correspondence with you and your office in 2020 drawing your attention to the outrageous miscarriage of justice carried out by your country’s corrupt judicial system. Despite our making it abundantly clear that corruption had taken place in this case you and your office provided no admission of fault or even help in trying to save the souls of two very vulnerable young children. We thought you would be an outsider who would come into the Austrian judicial system as an avenging angel.

We have heard your empty platitudes and your hypocrisy about how you are going to ‘modernize justice and bring it nearer to the people’!

You are trying to show humanity to the oppressed people in Ukraine. How you want to help them? You are a woman! Why can’t you save Ukraine and the Schlesinger Twins at the same time?

We sent you an email on 16th February advising of the result of a recent application for visitation which resulted in NO CONTACT whatsoever being given by Judge Gottlicher for Beth to see the twins. YOU DID NOT REPLY! We posted to you on 23rd February another letter describing the twins and our daughter’s terrible situation – a mother to have NO CONTACT with her children and the children to have NO CONTACT with their mother. YOU DID NOT REPLY!

Sometimes a situation is too immense or difficult for one person or even one country to resolve.

You, on your own, cannot stop the invasion of Ukraine by Russia. You can talk about the humanity and echo all the other empty sentiments but in the case of the Schlesinger twins it is within your power to actually achieve something. You are the Justice Minister for the Republic of Austria. You head the system. This is a manageable objective for you to attain (should you have the will to do so).

Bring the clear, apparent injustice to an end. Investigate this case. It is full of perverse ridiculous absurd decisions.

Children and their mother to have NO CONTACT WITH EACH OTHER! Think about that for a second. Mothers are being separated from their children permanently in Ukraine because their children are being KILLED by Russian bombs. The Schlesinger twins are thank god still alive but are being damaged by this enforced separation. How does it feel to know you have the power to stop this psychological damage or ignore it and let it continue. It goes against every legislation which your lawmakers have ever made! You are all complicit in the damage you are doing to these children.

The twins are 12 years old. They are coming to the end of their childhood. It is not too late for them to be reunited with their mother and begin to repair the huge damage this has already caused them and at the very least they deserve the unconditional love and hugs from the mother who gave birth to them and who have had an enforced separation through the corrupt rulings by your judicial system. And just to remind you there has never been any plausible explanation for this cruelty.

AN OPEN LETTER TO HARAV SHRAGA FEIVEL ZIMMERMAN

Dear Rabbi Zimmerman,

I saw on the Federation website, the video you recorded about the necessity to report abuse and the hilchot that say it’s our duty to prevent a person being harmed from the person who is harming them. There was no contact address for you so I am sending this email to all the Federation communities in the hope that it will find you. This is not a bad thing, as Rabbi Raphy Garson of Ohr Yisrael in Borehamwood says, “Together everyone achieves more.” By the way, I was moved to see that the Congregation of Jacob Synagogue in Commercial Road is part of the Federation. This shul was founded by my two Great Grandfathers – Reb Abraham Schwalbe and Reb Moshe Koenigsberg.

Perhaps you have heard of the twins Benjamin and Samuel Schlesinger of Vienna, Austria who attend the Lauder Chabad Campus School? After their parents divorced, the courts awarded custody of the then 2-year-old boys, to their father, Dr Michael Schlesinger, a man with a history of violent domestic abuse resulting in a restraining order against him. This happened 10 years ago. We can do little about the fact that both he and Rabbi Jacob Biderman, the Principal of the school, lied to the court about the mother, Beth Alexander’s mental state and her ability to raise her children.

Since then, Schlesinger has done everything he can to deny all contact between Beth and her sons. Unfortunately, he is not a member of your community because the Vienna community has turned a blind eye to the fact that he is more interested in hurting Beth than he is concerned for the welfare of his children. However, Rabbi Biderman is of your profession and also a prominent member of Chabad to which I know many of your Rabbis also belong.

You can do something about the abuse that ensued and that has been ongoing for the past 10 years. Contrary to Austrian law, the Principal of the Lauder Chabad School and Chabad Rabbi, Jacob Biderman, has blocked Beth from all contact with the school and her children’s education. She has been barred from every birthday party, every celebration and school event, and he refuses to give her any information about her sons’ welfare or progress.

Biderman claims that Schlesinger’s lawyers wrote to him and told him to do this. However, the lawyers denied any such letter under oath and no letter has ever been produced. No one made Rabbi Biderman erase their mother from the school lives of two innocent boys. He took it upon himself to go the extra cruel mile and cause 10 years of suffering for the little boys in his “care”. Their mother sent him numerous emails begging him to let her be part of their school lives, emails which he dutifully forwarded to the lawyers of the ex-husband, and then ignored.

Now the boys are coming up to Barmitzvah in June of this year. It is not too late for them to know that their mother loves them and has never stopped fighting for them. It is not too late to stop this abuse of their human rights to their mother’s love.

Chief Rabbis Jonathan Sacks z”l and Ephraim Mirvis, both spoke to Biderman and were assured that changes would be made. He reneged on all his promises. Rabbi Brodie z”l of the Manchester Beth Din wrote of his incredulity that baby boys could be brutally parted from their mother when she is alive and available to give them all her love. Others have remarked that you would need to be an axe wielding murderer to deserve the punishment inflicted upon Beth. Everything is documented and recorded.

In desperation, more than 6,000, mostly Jews, have created a Facebook group – Reuniting Beth With Her Boys - to try to get justice for Benji and Sammy. And for Beth. Maybe you, Rabbi Zimmerman, who understands the despicable nature of child abuse, will be the one Rabbi who can finally help them. Chabad are only interested in global tragedies where they can show, in the words of Rabbi Y.Y. Schochet, “The indomitable spirit of Chabad.” Where is their spirit when two young boys are denied their mother and the perpetrator is within their gates? Why is not one Chabad Rabbi willing to stand up for two children who have no voice?

You are 100% correct that we must report abuse and do everything in our power to stop it. 6,000 of us are looking to you Rabbi Zimmerman, to try to get justice at last for Benji and Sammy Schlesinger. I eagerly await your reply.

AN OPEN LETTER TO RABBI Y.Y. SCHOCHET OF MILL HILL SYNAGOGUE LONDON


 

Dear Rabbi Schochet,

I am writing to you after seeing your post on Facebook about the selfless actions of Rabbi Wilhelm of Zhitomir, Ukraine. He is evidently a man truly to be honoured and worthy of public acknowledgement.

Then I saw your closing words: The indomitable spirit of Chabad, and my stomach turned. Chabad is not what it one was under the wise guidance of The Rebbe. Chabad seems to have lost its way, caught up in the fact that local politics are intrinsically linked to the financial wellbeing of the Chabad Shuliach’s own family as well as the programs he wishes to implement.

I have been campaigning on behalf of Beth Alexander, formerly of Manchester, then as a young bride, of Vienna, Austria, and now living in London, where she practices as a lawyer. You may have heard about Beth and her twin sons, Benji and Sammy Schlesinger. We started a Facebook group (Reuniting Beth With Her Boys) which has more than 6,000 members, in an effort to mobilize the power of community to right a tragic wrong and travesty of Jewish values.

In case you are not up to speed on this, 10 years ago, Beth’s two year old babies were taken from her home. The Police who accompanied the social workers were perplexed as why two happy toddlers and their loving mother should be brutally separated in this way. The Austrian, non-Jewish social workers tried to help Beth, not seeing any reason for her to lose her children.

The immediate, shocking change of custody followed a court case where the judge ruled Beth was incapable of looking after the day-to-day needs of her boys. This was based on evidence brought by the ex-husband, Dr Michael Schlesinger, a man with a history of violent domestic abuse who previously had a restraining order against him. Astonishingly, the story, which I have read on the court documents, was this: After the boys’ brits Beth, a young and first-time mother, was beside herself with worry when the anaesthetic wore off and both babies woke up in agony. The father, a medical doctor, had gone to a barmitzvah party. In desperation, Beth called him and he tried to instruct her by phone how to medicate the babies with suppositories – not something widely used in the UK. When she couldn’t manage, he became angry. This was the gist of the evidence, that two years prior, a young mother was distressed by her babies’ pain and disturbed her husband while he was enjoying a party.

There was also a false psychiatric report stating that Beth had suffered from post-natal depression. She hadn’t, it was anyway two years previous to the case, subsequent [and impartial] psychiatric reports showed that her mental health was perfectly ok, and post-natal depression is no reason to have your children taken from you two years later! You would have to be an axe wielding murderer to be punished as Beth was. Her crime? She married a violent, abusive, and subsequently vindictive man, whose need for revenge outweighs any concerns for his sons’ welfare.

I don’t know why a whole community rallied around Michael Schlesinger and helped him spread rumours about Beth’s mental health. He is not a rich man. However, I suspect he knows too much about the dodgy financial goings-on in that community (you can see the video about it on the “Help Beth” You Tube channel) and they could not risk such a loose cannon. (There is also the involvement of a Jewish judge, a friend of Schlesinger, who has been influential in this case.) A look at the some of the other videos will instantly show you that Beth was and is a loving and responsible mother.

This is a long introduction to get to my point about Chabad. As you will see from my letter (attached), Rabbi Jacob Biderman abandoned all moral decency in his bid to curry favour within the community. He ignored the confusion, depression and suffering of two little boys in his care by blocking Beth from all contact with her children in his school. He lied that Schlesinger’s lawyers had written to him instructing him to do this but they denied this under oath and no letter could ever be produced. Even as little Benji was ramming himself into a brick wall to numb his pain, as reported by an independent social worker, Biderman told the court that the boys were thriving with their father.

For ten years, despite pleading letters from Beth (which Biderman dutifully forwarded to Schlesinger’s lawyers), she has been barred from attending her children’s birthday parties and other celebrations in school, and has been denied all information about their welfare and progress.

Many of us have written to our local Chabad Rabbis. The responses have been shocking, as you can see from my letter to Chabad. Since then, other Rabbis have replied that it’s all lies – having taken about half an hour to “thoroughly research the case.” I have been contacted by a former worker at Chabad who told me that the conflict of interests between what is right and the need for the Chabad Shuliach to cover his expenses, including his own mortgage, has led to many unsavoury situations around the globe.

However, we are not talking about an extra aliya in shul or a front seat, or other honours that a Rabbi could legitimately and justifiably bestow in return for financial contributions. We are talking about the absolute cruelty of depriving two young boys of all contact with their mother for 10 years! Chief Rabbi Mirvis flew to Vienna to talk to Biderman and got some assurances which Biderman then reneged upon. Other Rabbis have also tried to reason with him to no avail.

The situation now is that all appeals to the Austrian courts have been denied – the same judge has been presiding over this case for 10 years so she’s not going to re-examine her own performance – and all contact between Beth and her boys has been stopped. They say it is at the boys’ request but what 12-year-olds want nothing to do with a mother who has only ever loved them unless they are influenced or intimidated into this position? Schlesinger continues to taunt Beth with hateful text messages telling her how much the boys hate her, how they are ashamed of her, and that this is all her own fault.

There is little we can do against the corruption of the Austrian Family Courts, although we have not given up trying, but we all know there are ways that Jewish leadership can apply pressure where there is outrageous chillul Hashem. And yet, Chabad do not want to know. They will not rock the boat for the sake of two innocent boys. Chabad have lost their way. Stories of our great Rabbis of yesteryear are not all about the grand gestures of public heroism. Rather it is the humble and private mitzvot that give relief to a suffering soul with no expectation of reward, that we are taught to revere. Where is Chabad when they are called upon to challenge corruption within their gates? Why is the destruction of one Jewish family unimportant among the mitsvot and middot Chabad claim to uphold?

I would really like to hear your thoughts on this subject. In the interests of disclosure, I will be sharing this letter openly as we have learned that discreet enquiries and secrets do nothing to help. I hope you will reply, but you should know that your reply will also be shared.

An open letter to Chabad/Lubavitch HQ

I am sorry to report that we seem to have uncovered a deep fault in the Chabad/Lubavitch worldwide organization. Many of us grew up hearing amazing stories about the great work that Chabad centres do around the world. How they help Jewish travellers in India, provide communities for Jews who would otherwise have none, rescue and de-program misguided Jewish teenagers from cults, set up orphanages in Eastern Europe, etc… The stories are endless and, until now, have created a glowing picture of Chabad as truly being “Hashem’s Army.”

In our campaign to help the twin boys, Benji and Sammy Schlesinger be reunited with their mother, Beth Alexander, after a decade of obstruction by Rabbi Jacob Biderman of the Lauder Chabad Campus in Vienna, Austria, we learned a lot about how the Chabad shlichim (emissaries) work. When we see the massive conferences in New York where the shlichim come together from every corner of the planet, we are encouraged to think of Chabad as one large family under the authority of 770 NYC. Apparently, this is absolutely not the case.

We assumed that informing Chabad/Lubavitch HQ, and other Chabad Rabbis in different places, about how Biderman used his position to help erase their mother from the lives of two little boys who were obviously confused, depressed and suffering, would result in at least some interest from Biderman’s fellow Rabbis as to how he could do such an outright chillul Hashem. We are shocked by what ensued.

We are a group of more than 6000 supporters of Beth. Ordinary people from all walks of life, mostly Jewish but not all, and from all over the world. We only want two innocent Jewish boys to experience the love of their mother before it’s too late and they grow up thinking she doesn’t care about them. We don’t want revenge or money. We just want justice for two children who have no voice in the corrupt and hostile environment of the Lauder Chabad Campus.

We received a number of replies from Chabad Rabbis and/or their wives. We were informed that every Chabad centre is autonomous. Every Chabad Rabbi is responsible for raising his own funds among the community he “serves” and works however he sees fit. Who knew? Many of us learned something we didn’t know before. However, no Rabbi or Rebbetzen wanted to get involved. Not to make a phone call, ask some discrete questions, or interest themselves in any way in the plight of defenceless children.

And yet this was not the most shocking part. Not one reply was honest enough to admit that they don’t want to rock the boat and cross a powerful Rabbi in a rich Chabad community. After all, how many of them are as successful as Biderman in Vienna who has his own K-12 school campus? Instead, we got lectures in how we perhaps don’t know the whole story, there are two sides to every coin, etc...

Believe me, we know the whole story. And even if there was something we don’t know, what could possibly be so heinous as to bar a mother from attending her children’s birthday parties in school? Refusing her any information about their wellbeing or progress? What could Beth Alexander have done that allowed Rabbi Biderman to lie to the courts on behalf of her ex-husband? What sort of a monster would the mother have to be for a Rabbi to break one of the 10 Commandments? One look at the videos on the You Tube Chanel “Help Beth” would reassure anyone that the extreme measures Biderman took to separate the boys from their mother, was unfounded and downright cruel.

Now we know that Rabbi Jacob Biderman decided to follow the money because caring for the welfare of two children in his care above his own personal success, would not get him his school, would not pay his personal expenses, would not provide a house for his family to live in, and – most shockingly – would not necessarily gain him the respect and standing among the other shlichim who can only dream of the resources Biderman has at his disposal. But at what cost? According to Jacob Biderman, destroying the lives of one Jewish family is not a high price for the Jewish world to pay.

This is the problem with Chabad/Lubavitch. They hide behind the good name of the organization that is based on the righteous work of some of its members, whilst in reality, it’s every man for himself. And if one Rabbi threatens the good name that brings in the money worldwide, all they want is to hush it up.

But perhaps I am being too harsh. Many of us suspect that the reason they harp on about two sides to every story, etc… is that it absolves them from dealing with the uncomfortable thought that some Rabbis among them are corrupt. For some Rabbis, like Jacob Biderman, the money might be their top priority. That their beloved Chabad might be supporting “Rabbis” who are not worthy of the name, may be too hard to contemplate. Better to make excuses and not open that potential Pandora’s box.

Now we understand that Chabad is not Hashem’s Army at all. It is a loose collection of communities run by individuals with no accountability to the organization whose erstwhile good name they can exploit should they so wish. From now on it must be known that Chabad just means Jewish, and like, the whole of Am Yisrael, there are good and bad souls among them.

As such Chabad no longer means anything. Your Rebbe must be turning in his grave.

FEDERAL MINISTRY REPUBLIC OF AUSTRIA

 

Good afternoon Ms Schmid,

I write in regard to Mag. Botta's letter to a Ms Ruth Leveson dated 24. February 2022.

Naturally the details of the case cannot be disclosed to third parties.

I respect that the case was conducted by independent courts of law and wanted to bring to your attention some irregularities which may have fallen through the cracks in Austria's otherwise very good justice system.

1. There has been no "Serious Case Review" of the whole case by independent judges. An Austrian appeal court in October 2011 upheld the mother's allegation that a senior judge, Mag. Konstanze Thau, interceded irregularly on behalf of the father - a close personal friend and alleged abuser - to prejudice the decision of Mag. Susanne Göttlicher. Your appeal court ordered a new evaluation of the mother and returned the case to the lower court. At present, the lower court has not considered the High-court-ordered evaluation and has not given a reason for this. The most recent appeal decision does not review or revisit the alleged irregularities in the original custody award. In addition, Mag. Gottlicher was allowed to hear the application for a change of judge, whereas this should have been heard by an impartial judge. We are therefore urging a serious case review by the Austrian Judiciary under the United Nations Basic Principles on the Impartiality of the Judiciary.

2. The mother has a plausible allegation of domestic violence. Ms Alexander’s case is being supported by Domestic Violence organisation Jewish Women’s Aid: Dozens of expert professionals have considered the mother’s testimony to be truthful. The Austrian state is currently leaving children in the custody of a man whom professionals consider coercively controlling. UK law considers witnessing domestic abuse to be child abuse. If Austrian law is the same, then leaving child victims of alleged abuse in the custody of a man whom expert professionals consider likely to have abused their mother in their presence is an urgent matter for the courts.

I would appreciate if you could pass these concerns to Mag. Botta for a determination as to whether a serious case review is indicated.

Dear Valentin, Alma and Alexander,

I am writing to you as a member of the Women's Equality Party, UK. We share many of the same aims as the European Greens, especially relating to social justice.

Beth Alexander, is a British woman who lived in Vienna, now the UK. On divorce, her 2-year old twins were given to the custody of her ex-husband. More recently, her ex-husband has cut off her contact with them. The Austrian court has repeatedly rubber-stamped the ex-husband's demands. Beth is concerned that this is because he has personal contacts within the court system and she has evidenced this. Beth has a Facebook page - "Reuniting Beth with her Sons" with approximately 6000 members. Many women on it, across various countries, have suffered similar experiences. I am concerned that because of the pan-national nature of this phenomenon, there is some reactionary force, orchestrating it.

Please can Alma look into this case personally. A member of the group has written to her at the Ministry, but the reply, dismissing Beth's concerns was sent by Martin Botta. We do not know if Alma is aware of the case - or others like it.

Lauder Chabad Campus: “The Perfect harmony between Austrian formal education and Jewish teaching of the heart and spirit” (as written on their Facebook page) I’d like to know, is that the same “heart and spirit” of the twin boys you’ve stripped of seeing their mother for 10 years?

Is this the same “heart and spirit” that you’ve blatantly stopped a mother from attending every parents’ evening, every concert and birthday party since they were in the Kindergarten? Is this the same “heart and spirit” that despite a mother recording that one of her children was deliberately ramming himself against a wall in an act of self-harm, Rabbi Biderman testified in Court that both twins were ‘thriving with their father’. Is this the same “heart and spirit” that you wrongfully reported Beth Alexander to be mentally ill – despite knowing full well that this was a lie?

You may succeed to continue to pull the wool over the eyes of innocent families who may think by sending their beloved children to your school will be a good choice but we hope they’ll think again once they’ve read and learned what lies beneath your fake veneer ‘to grow up with joy and confidence’. Together with the Austrian courts, you have been culpable in damaging these poor children.

One doesn’t need to be a psychologist to know the mental damage these children will have suffered as a direct result of their treatment of which you are in part hugely responsible, having withheld them from being with their mother. The boys have been and continue to be used as pawns throughout this ghastly 10-year episode and I wonder, did anyone stop to think and ask them what they wanted? Granted if you ask them now – I believe they’ve been so heavily brainwashed in favour of their father – but you tell me: which child do you know who would ever elect to be without their mother?

A final note to the entire Lauder Chabad establishment: You may think it unnecessary for your names and school to be brandished across social media – but you’ve not seen anything yet! There are several thousands of us from all over the world in support of Beth and we are not going anywhere. In fact, we are just growing in numbers and support. We are fully supported by Chabad in our local communities with whom we’ve all raised your behaviour and coercion. Our local Chabad Rabbis are quite frankly sickened and ashamed by your involvement.

I/ we will continue to knock on your door; we shall continue to make so much noise; we simply will NOT stop, nor will we go away until there’s an independent investigation and only once Beth has been reunited with her boys. You may think that it’s a little ‘unnecessary’ for the several thousand of us from all over the world, to have taken to social media – but you just wait. This is only the very beginning. Karma will prevail.

Open Letter To Jacob Biderman : LAUDER CHABAD IS GUILTY

CHABAD DENY CULPABILITY

I am writing to you, Rabbi Jacob Biderman, because I believe you have a right to know that the linked document is being sent all over the Jewish world and beyond. We are posting it on all relevant social media platforms and websites. To be clear, this is not a hate campaign against you. Rather it is a justice campaign for Sammy and Benji Schlesinger – two young pupils in your school who have suffered a decade of unimaginable heartbreak as their mother has been erased from their lives.

How could you do this to innocent children? You call yourself a Rabbi yet your heart is rock hard. You lied to the courts about their mother. You have no understanding of a mother’s role in the lives of her children. Jewish Law excuses mothers from all the mitzvot that are time constrained. Our great Rabbis and Hashem Himself knows a mother needs to be constantly available to her children. That their mother’s love and guidance is crucial for their wellbeing.

Did you miss this lecture in Yeshiva, Rabbi Biderman? Did you also miss the lesson on the 10 Commandments where it says you shall not tell lies against your neighbour? Ten Yom HaKippurim have gone by since you decided to help Michael Schlesinger destroy his wife and inflict as yet unknowable damage on their children. What were you doing on these holiest of days when you should have been atoning for your sins? Did you give one thought to the evil you were perpetuating year after year?

Yes, we are telling everyone not to enrol in your school because until you even understand what you have done, it is too risky to allow children to be in your care. You had the audacity to reply that this was a private family matter and that the school did not involve itself. Really?!! Now you are SUDDENLY impartial?!! After you took it upon yourself to block Beth Alexander from all contact with her sons? After you give her no information about their welfare or their education?!! After you barred her from attending their birthday parties in school?!! After you ignored the confusion and depression of two little boys in your care and told the courts they were thriving?!! Or maybe you didn’t notice, which is even more alarming from someone in charge of a school.

Call yourself a “Rabbi” if it makes you feel important. You are no Rabbi to us. For now, all we can hope for is that you aim to be a mere mensch. Until you understand what you have done and try to repair some of the damage you have caused, we will continue to fight for justice for Sammy and Benji. Someone has to advocate for them. Sometimes teachers can intervene to help vulnerable children. In this case it was their teacher, Jacob Biderman, who ensured they remain vulnerable.

We are more than 6,000 people dedicated to Beth and her children. We are not duplicitous as you were when you forwarded Beth’s pleading and heartfelt emails to her ex-husband’s lawyers. We only deal with the truth, unlike you when you told UK Chief Rabbis Ephraim Mirvis and Jonathan Sacks, of blessed memory, that Beth was mentally ill. We will not go away. Until this is resolved satisfactorily, this truth will follow you for the rest of your life, from job to job, and from community to community.

Ask yourself how the name of Rabbi Jacob Biderman will be remembered. What will your legacy be in this world? I can tell you that it will either be the story of how you destroyed the lives of a Jewish family to further your career, or it will be how you repented and ended up on the side of goodness. Your choice. Either way, the Jewish world will know. We all eagerly await your decision for the final chapter of this tragedy that you helped to create. Remember that according to Jewish law, real atonement begins with asking forgiveness from those you have wronged. Although how you can apologise to children for keeping their mother from them for ten years, I cannot imagine.

For full disclosure, I am copying this email to Ronald Lauder, Chabad HQ, and Chabad Rabbis around the world. It is also their right to know what is happening in a school that bears their names. Please don’t waste everyone’s time by crying that this is all lies. Everything is officially documented and recorded. Your only honourable course of action is to look inwards, examine your past behaviour, choose a new path of honesty and righteousness, and pray that God will forgive you for what you have done to his children.
